The following Terms and Conditions govern your use of Steffes Auctioneers live webcast auction system. These Terms and Conditions must be accepted without modification before you may register for access to this service. These Terms and Conditions constitute the entire agreement between you and Steffes Auctioneers and the use of our live webcast service.
- Cost: To help defray part of our costs of operating the live webcast auction system and absentee bids, we have instituted a 2% per item (maximum of $500 per item) convenience charge for Internet purchases. This charge is also applied to any form of absentee bidding whether by Internet, fax, phone or other means.
- Registration to participate in our live webcast auctions. Upon our acceptance of your completed registration and receipt of your bank reference letter, the bid number and password you received upon registration will be activated and become your PERMANENT live webcast bid number and password which will identify you whenever you place bids using our live webcast system. This number and password is not valid for either the online only auctions or auction results. The number and password you receive will be enabled to log on and bid on Steffes Auctioneers live webcast system . PROTECT AND KEEP CONFIDENTIAL YOUR BID NUMBER AND PASSWORD. By acceptance of these terms and conditions you agree to be held financially responsible for any and all purchases made using your bid number. We reserve the right, in our sole discretion, to allow or deny access to our services to any party or to revoke any bid number and password at any time.
- You are solely responsible for the accuracy of your Bidder Information and you hereby warrant that your Bidder Information is true and accurate. You hereby certify you are of legal age, possess the legal capacity and the financial means to participate in the online auctions.
- You acknowledge that Steffes Auctioneers and it's Employees act merely as agents for sellers. While the information we provide on item(s) is deemed correct, no warranties are expressed or implied as to any items being sold and you agree to purchase and accept the item in an as-is condition. Information on items is obtained by us from the sellers and you hereby agree to hold harmless Steffes Auctioneers and their Employees for any errors or omissions regarding the item(s) being sold. This information includes but is not limited to year, model, machine or engine hours, physical condition, options, features and other data pertinent to the value of the item. ALL ITEMS ARE SOLD AS-IS WHERE-IS.
- You acknowledge that you have the right and responsibility to inspect the item(s) personally, or to have a third party representative inspect the item(s) for you. That by bidding on an item you have agreed to accept that item in it's present condition and with the description provided whether accurate or not.
- You agree that all sales are final. Upon your becoming the Purchaser of an item, that item shall immediately become your responsibility and be at your risk (whether you have paid for that item or not). You agree that Steffes Auctioneers and it's employees are not responsible for lost, stolen or damaged items and will not reimburse or discount items for any type of loss.
- You agree to forward payment for all online purchases in U.S. Funds via Overnight Mail within 1 day of receipt of invoice. Those payments will be sent to Steffes Auctioneers Inc., 3509 Interstate Blvd SW , Fargo , ND 58103-2200 . You acknowledge that we reserve the right to hold all items until your funds clear our bank. Payment can also be made personally at one of our offices within 24 hrs.
- You agree to remove from the auction property any purchases within the stated time for the auction being conducted. You further understand and agree that failure to remove items in the stated time for the auction will subject you to moving and storage fees.
- You agree that when using our online auction services you are making firm commitments to purchase said item(s). Bids may not be cancelled or retracted for any reason. You also acknowledge that the Internet may be an unreliable and error prone network and Steffes Auctioneers will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Steffes Auctioneers and their employees harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Steffes Auctioneers retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice.
- You acknowledge and agree that Steffes Auctioneers, their web sites, and any software and information used in connection therewith contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that any content contained on their web sites is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
